The frame of mind of the objectors is readily understandable. However, unfortunately, little can be done to avert their apprehension about the proposal, although, from purely an objective point of view, it can be demonstrated that the safety requirements and the distance of the gasholder from the nearest residential development is such that probability of a catastrophe occuring is virtually non-existent.

The existing gasholder at Smithfield is potentially much more hazardous because of its close proximity to built-up residential areas and with the redevelopment of residential buildings around Smithfield proceeding apace, there is some urgency to have it removed to what is clearly a much more suitable site. For the above reasons, it is recommended that it should be declared expedient to grant a lease for the gazetted foreshore and sea bed to the Company and that the objections referred to in paragraph 4 above should not be upheld. The term of grant will follow approved policy for private treaty grants to public utility undertakings.

In order to provide access to the proposed gasholder site, it is necessary to reclaim an area about 2,305 square metres of foreshore and sea bed at Shek Pai Wan. As stated in paragraph 3 above, the formation of this road will be undertaken by the Company as a condition of the grant. In accordance with section 2 of the Public Reclamations and Works Ordinance notices were first published in the Government Gazette on 29th September 1978 and in the press of the proposed reclamation of an area of about 2, 305 square metres of foreshore and sea bed as delineated red on the plan at Annex G. During the statutory two-month period for objections and claims, an objection from Mr Ma Kam-wong was received and a copy of his letter is at Annex H.

The stated grounds of objection are that the proposed reclamation will affect the objector's temporary structure used as a latrine; the public footpath along the shoreline; and the outfall of an existing pigs' dung sewers.

The objector occupies a tolerated structure erected on Crown land nearby without any licence or tenancy. His latrine is an elevated wooden structure with its foundations below the High Water Mark. As his other structures lie partly within the area
