An Ordinance to amend the Clean Air Ordinance.
[20th July, 1979]
Enacted by the Governor of Hong Kong, with the advice and consent
of the Legislative Council thereof.
1. This Ordinance may be cited as the Clean Air (Amendment) Short title. Ordinance 1979.
Section 2 of the principal Ordinance is amended by inserting, Amendment of immediately before the definition of "approved device", the following section 2.
""Air Pollution Control Officer" means the Air Pollution Control Officer appointed by the Governor in accordance with section 10;".

3. Section 4(1) of the principal Ordinance is amended by inserting Amendment of after "competent authority", in both places where those words occur, the section 4. following-

"or the Air Pollution Control Officer".
The principal Ordinance is amended by adding, after section 9 Addition of the following section-
"Limit of time for laying information.

9A. A complaint or information in respect of an offence under section 8(a) or under regulation 12(1) of the Clean Air (Furnaces, Ovens and Chimneys) (Installation and Alteration) Regulations shall be made or laid, as the case may be, within 1 year from the time when the matter of such complaint or information respectively arose.". Section 10(1) of the principal Ordinance is amended- (a) in paragraph (a) by deleting "; and" and substituting the
following-

"generally or for the purpose of any provision of this Ordinance;";
(b) in paragraph (b) by deleting the full stop at the end and substitut-
ing the following-
"; and";
(c) by inserting after paragraph (b) the following—
"(c) the Governor may appoint a public officer by name or
office to be the Air Pollution Control Officer.".
