A requirement of Government paying you the amount offered will be that you agree that this amount will be offset against the final averd made by the Lands Tribunal and you must satisfy the Government that your title to your premises is good.

In addition to the compensation the Government is required to pay for your interest in your property, Government is prepared to pay the occupiers of residential accommodation an ex-gratia allowance to. cover the disturbance caused, This allowance is based on Tenancy Tribunal rates for the location and is assessed on the actual arta occupied.

Occupiers of shops or workshops are also entitled to this ex-gratia allowance based on Tenancy Tribunal rates for shops, but it will have to be offset against any agreed or awarded claim. The reason for this is that a business can claim under the lass Transit Railway
Land Posumption and Related Provisions) Ordinance for disturbance due to removal to alternative premises as a result of the resumption of the shop or workshop. In order to assess such a loss, I will require to see receipts of actual costs incurred as well as your business accounts (preferably audited) for the last 3 years.

Government is also prepared to offer one further form of cx-gratia allowances to owner-occupiers of residential accommodation. If an omer/occupier wishes to purchase a flat which costs more than the compensation paid to him for the resumed flat, Government will give him an allowance to cover the interest element of any mortgage he has to take out, details of which were advised in my letter of 18th July 1978.

In order that I can start assessing your compensation, I will require your consent to view the promises in question. There are tuo reasons for this. In respect of the value of your interest, any improvements carried out since the property was built could enhance its value. As explained carlier, I am required by law to assess the full market value which would include the value attributable to any improvements. and such items as fixtures and fittings. The sc cannot be seen from an cxamination of building plans. Secondly, as explained by pera, 8 above, occupiers are entitled to an ex-gratia allowance to cover disturbance. The assessment of this allowance is based on the arca occupied by each family. It is not necessary to take measurements of your flat/shop to assess its velue, áll I want is for my staff to have the opportunity to view it. This will take, on average, about quarter of an hour. Measurement of your flat/shop is necessary to assess the ex-gratia allowance for disturbance as this is based on the actual area occupied. To allow this viewing and taking of measurements in no way affects your rights to possession of your property until 12th November 1978, to. remaining in occupation until April or May 1979 if you wish or to a hearing before the Lands Tribunal if you disagree with the assessment of the full market value of your property. It is purely to assist me in assessing the compensation payable and thereby give me an opportunity- to make an offer of the amount of compensation.
