Resumption of Property at Sai Lau Kok
Shop/Flat
I am writing to inform you of the present position regarding compensation in respect of the resumption of the above premises,

As you are aware, your premises will revert to the Crown on the 12th November 1978 and, in due course of time, about April or lay 1979, you will be required to give vacant possession.

I have been charged with assessing the compensation which the Covernment will have to pay to you for your flat/shop. Under the Hass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap. 276), you are required to submit to the Director of Public Works, within 1 year of the premises reverting to the Crown (i.c. 12th November 197 a claim of your loss. The Director of Public Works, on receipt of your claim, then has 3 months cither to accept it, reject it, or accept parts and reject other parts. In the event of the claim being rejected, wholly or in part, you are then entitled to have your claim heard by the Lands Tribunal.

It is appreciated that this procedure will cause hardship' particularly to those owners who are occupying their own properties, as many of you may like to purchase or rent alternative premises before you are required to vacate.

To assist you in this matter, I am prepared to value your premises before the date of reversion with, a view to negotiating a settlement of the amount of compensation the Crom will offer. Such an offer must initially be paid on an ex-gratia basis, with a formal offer to be made as soon after the 12th Noventer 1978 as possible. This final offer will be based on the full market value of your premises on the 12th November 1978.

If you consider that the final offer is insufficient, you will be required to submit a claim in accordance with paragraph 3 above. However, irrespective of whether or not you accept the offer, the Government is prepared to pay you the amount of the offer prior to you vacating your premises on the basis or 50% of the offer on you indicating that you (and/or your tenants if your premises are tenanted) are prepared to move and the final 50% on your giving vacant possession. You will retain your right to having your clain heard by the Lands Tribunal if you consider the final offer to be insufficient.
