The purpose of clause 3 is to authorise the exercise of legislative and executive powers after 1 July 1997 but not to affect their exercise up to then.

4. I agree that clause 3 is somewhat circular in appearance, and perhaps a better word than "administers" can be found. discarded "possesses" as the Chinese might take exception to it, but "occupies" or "is responsible for the government of" might be an improvement.

However,

I had originally 5. I see that clause 4 may be faulty. intended it to continue in the same way as clause 3. it might be better simply to say that the provisions of this Order are without prejudice to the provisions of the 1898 Order.

6. I should be happy to prepare an amended text in consultation with you before you submit to the Attorney, but would need to clear it with our Hong Kong Department and the Governor.
