1. I attach a copy of a self-explanatory letter from the Governor of Hong Kong (dated 21 December) together with coples of its enclosures.
2. Paragraphs 7-9 of the letter discuss the form which the Order-in-Council should take. You will see that the Governor encloses a draft (Annex A) which he has prepared following discussion with HM Ambassador in Peking, but says that he would be prepared to accept the draft which we have proposed (Annex B) subject to certain amendments.
3.
I should be grateful to know whether the Governor's preferred draft (Annex A) is acceptable from the legal point of view, or whether you consider that we should insist on the longer version prepared here. In the latter event, it would be helpful to have your views on the amendments suggested by the Governor.
4. I am at your disposal if you would like to discuss these points. At some stage we will presumably need to consider when and how to put the problem to the Law Officers.
