I am grateful for your views on the two drafts Order-in-OUD!! Council proposed by the Governor in his letter of 21 December: one preferred by the Governor, and the one worked out by you and Mr Hobley (your minute of 3 January - copy attached for Mr Samuel).

In the meantime HM Ambassador in Peking has indicated that he shares the Governor's preference for the shorter version (Peking telegram No 16), and the Governor has suggested an amendment to his own draft in the light of Mr Cradock's views (Hong Kong telegram No 68). I attach copies of these telegrams since I see that you were wrongly omitted from the original distribution.

I should be grateful if you would take another look at the various texts and consider whether we should still insist on your latest draft, in view of the Governor's second thoughts.
4.
Once we have reached a view on the legal point we will need to consider how best to take matters further. It might be useful to have a small meeting for this purpose. If you and Mr Samuel agree, I will ask my PA to arrange a suitable time.
