(4) If the officer does not admit in whole the
misconduct but admits in part the grounds on which
it is proposed to cause the investigation to be made,
the Governor may
(a) if the grounds admitted amount to misconduct,
dispense with such investigation, unless the
officer requests that the investigation
be made, and inflict such punishment upon
the officer in respect of the grounds admitted
as may seem to him to be just; or
(b) if the grounds admitted do not amount to
misconduct, cause the investigation to be
made into the officer's conduct.
(5)
Where the Governor dispenses with an
investigation in the circumstances set out in paragraph (4), no investigation shall be made in respect of the
grounds that the officer has not admitted and he shall
not be liable to be punished in respect of those grounds.
