Clements was tried before Leonard J. and a jury of seven, for a period of 8 sitting days commencing the 12th December concludi 21st December when the jury after retirement of 12 hours unanimously found Clements guilty of murder.

The Crown's case in summary, consisted of the following :-

The homicide occurred between 2.30 a.m. and 3 a.m. on the morning 28th March, when the deceased met her death principally as a result of a broken left jaw severing her tongue causing loss of blood which she ingested, thereby causing her death by asphyxia.

Discovery of three palmar prints on a mirror wall inside the room where the deceased, Jenny Kwok, was found.

A taxi driver gave evidence that he took a European (describing Clements' appearance) from a spot near to the place of death (Kowloon side of Hong Kong Harbour) to the s.s. Acadia Clements was a cook on that ship), leaving Kowloon at 3.10 passing through the tunnel to Hong Kong Island and arriving at the ship just after 3.35 a.m. At a subsequent identification parade the taxi driver identified Clements. He also described his passenger as bleeding from the nose.

The ship's doctor saw Clements some time after 2 a.m. when he observed him bleeding from the nose was informed of a painful right wrist. He treated the wrist the following morning. The doctor was corroborated by the ship's laundry man who stated that the time would have been 3.15 or later. The effect of their evidence was to establish Clements' arrival at some time after 3 a.m. although neither was clear in his recollection as to
