Report on Alleged Frame-ups
Actual Cases
This report does not claim to give a fully comprehensive picture of all cases claiming frame-ups or police persecution. They are only a few of the nearly 200 cases dealt with in my office in the past two years, plus a few more cases which contacted me in prison, or through the prison authorities.
The cases will be grouped under three headings:
1. Reported in Mrs. Norah Bexhall's Report in 1977; 2. Cases reported in prison or through the prisons;
3. Cases attending the ward office, after Mrs. Bexhall finished her
report.
1. Mrs. Bexhall's Report (Taken from the Ward Records of 1976-7)
1) L/98/77

He and a friend had been playing chess. At about 2 a.m. he was waiting for a taxi in Cheung Sha Wan Road, 16th November, 1976, when he was arrested by four detectives. He had no previous record.
He pleaded NOT GUILTY. The case was dismissed. He had to pay legal expenses and waste a lot of time in court, but there was no redress without more waste of time and money.
2) L/2336/76
The three young men were arrested by 2 CID and forced to sign confessions that they were triad members. In court they pleaded not guilty. A lawyer was provided by the Legal Department of the University (A free advice scheme). The Magistrate ruled there was no case to answer and it was dismissed.
3) L/211/77
In February, 1977,
was looking at the pictures outside a cinema. He then went to sit in a playground. A Blue Beret Police- man approached him and asked if he was a triad member, When said he was not, the policeman touched his gun and threatened to shoot him if he denied it. When
still denied it, the police- man punched him and took him to Shek Kip Mei Police Station and charged him. He had no previous record.
pleaded Not Guilty in court but had no lawyer. The case
was dismissed.
4) L/1767/76

He is a worker, and was arrested on his way home at 8.30 p.m. He claims he was detained by police from 14th 17th September, 1975, and forced to sign a confession of being a triad member. Having no lawyer, and being under threat, he pleaded guilty. He had no previous record. A complaint was sent to H.E. The Governor on 25th September. After his probation report, he was given an absolute discharge with no record of conviction.
