As the land in question is agricultural land, compensation at the rate of $43 per square foot will be paid in accordance with memorandum XCC(78)85 approved by this Council on 7th November 1978. Clearance of this area will affect 28 families who will be offered permanent housing or temporary housing according to their eligibilities. Workshop operators will be offered ex-gratia allowance in accordance with the established policy but no reprovisioning will be offered as no flatted factory space is available in the Housing Department factory estates. The cost of resumption and clearance

is estimated to be $463, 450 and action to increase the project estimate to cover the recently approved higher rate of compensation for agricultural land is in hand.

The work is intended to start in June 1979 Resumption proceedings are recommended in order to avoid the delay which would arise if the ex-gratia terms offered to the owners are not accepted and subsequent resumption proceedings had to be initiated thereafter. However, the resumption notice will not be issued until the new terms of ex-gratia compensation have been formally endorsed by the Finance Committee and have been announced publicly. The resumption period will be three months during which period offers of compensation at the approved rate will be made to the owners.

Honourable Members will be asked to advise:

under section 6(1)(a) of the Streets (Alteration) Ordinance (Chapter 130), whether the proposed undertaking illustrated on the plan at Annex A should be authorised without modification;

and

under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the area shown coloured beige on the plan No KM1610 at Annex H is necessary for a public purpose, namely widening of the section of Junction Road from Tung Tau Tsuen Road to Fu Mei Road.
