The Director of Housing has advised that shop sites are no longer offered to shopkeepers involved in development clearances. An ex-gratia shop allowance will instead be offered on clearance if the objector is found eligible under the existing policy.

Although the proposed road widening project will involve the clearance of the objector's shop, it is in the public interest that the project should proceed. Accordingly it is recommended that the objection should not be upheld.

The objector has requested that the road widening plan should be withdrawn or, as an alternative, he should be granted sufficient compensation and a suitable site for the continued operation of his business.

The objector is operating a plaster workshop in a surveyed structure situated mainly on Crown land and partly on agricultural Lot No 577/3 section A sub-section 2 which will be resumed. As in the previous case, he is not entitled to claim for business loss under section 10(d) of the Crown Lands Resumption Ordinance as the lot is restricted to agricultural use. However, ex-gratia workshop allowance will be offered by the Housing Department upon the clearance of the workshop provision that it satisfies the necessary eligibility criteria.

As in paragraph 10 above, it is recommended that the objection should not be upheld.

The objector is the registered owner of agricultural Lot No 577/3 section A sub-section 2. The objector has requested that the road widening plan be withdrawn or as an alternative sufficient compensation should be paid for the resumption of his property which will be required to make way for the road widening project.

As compensation will be paid at the prevailing rate for the resumption of the agricultural land owned by the objector it is recommended that the objection should not be upheld.
