per family may be payable to these families. Genuine cultivator- families who opt to continue cultivation elsewhere may be eligible for an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing.

In addition to the 70 temporary structures mentioned above, a total of 105 other temporary structures on Crown land and on private land, including 2 shops, 19 workshops, 1 factory, 2 restaurants, 9 chicken sheds and 9 pigsties, will also have to be cleared. The total cost of ex-gratia allowances for the eligible undertakings is estimated at $284,000 and will be paid from the compensation vote of the Housing Department under which funds are available.

The institution of formal resumption proceedings is re- commended to avoid delays in obtaining the voluntary surrender of the private land which may be caused by succession difficulties, absentee landowners and prolonged negotiations with the landowners. As the land to be resumed lies within the boundaries of the New Town, the owners will be offered either land exchange entitlements on Letter B terms at a credit of $10 per square foot or cash compensation including an ex-gratia payment to bring the total compensation up to $17 per square foot if the cash offer is accepted prior to the expiry of the resumption notice.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely, site formation in Area 7C, Sha Tin, in connection with the Sha Tin New Town Stage I, Phase II development.
