RESUMPTION OF LAND FOR THE DEVELOPMENT OF REMAINDER OF AREA 25, SHA TIN NEW TOWN

Sha Tin New Town Area 25, which is situated near Tai Wai,

Part of is zoned for Government, Institutional and Community uses. the area has already been developed for primary and secondary schools, a government clinic, a church, a community centre, a telephone exchange, temporary sports and transport facilities.

In order to implement the development of the remainder of this area, the Director of Public Works has requested the resumption of 13, 120.1 square metres (141, 230 square feet) of private agricultural land in Area 25, Sha Tin New Town so that site formation and roads and drainage works may proceed. This project is in Category A of the Public Works Programme. Engineering work is scheduled to commence in September 1978 and will be completed by 1980.

The general location of the private land to be resumed is shown coloured orange on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the area of private land involved in this resumption is the minimum necessary to implement this project and has recommended that three months' notice of resumption be given. Compensation for resumption and clearance is estimated at $3.07 million and provided that land exchange entitlements are accepted as expected, the commitment will not result in the approved project estimate being exceeded nor exceed the financial provision for the year 1978-79.

The clearance will cover both Crown land and private land and will involve payment of compensation for crops, fruit trees, flowers, bamboos and miscellaneous items (accommodation works), together with ex-gratia allowance for cultivators as well as ex-gratia disturbance allowance for pigbreeders and poultry farmers.

No building land is involved in this resumption. However, thirty (30) temporary structures (10 on Crown land and 20 on private land) used for domestic purposes will have to be cleared. These
