offered space in a temporary housing area in Tuen Mun. Ex-gratia domestic removal allowance of up to $1,000 per family may be payable to these families. Genuine cultivator-families who opt to continue cultivation elsewhere may be eligible for an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing.

In addition to the structures mentioned above, a total of forty- nine(49) other temporary structures including a shop, a workshop and six(6) chicken sheds will have to be cleared. Ex-gratia allowance estimated to total $25, 000 will be paid for one shop and one workshop in accordance with current policy.

Negotiations to obtain voluntary surrender of the private land have not been successful so far and the institution of formal resumption proceedings is recommended in order not to delay development works. As this project is scheduled to commence in June 1978, it is recommended that two months' notice of resumption be given.

As the land to be resumed lies within the boundaries of the Tuen Mun outline development plan, the owners of the agricultural land will be offered (subject to there being no change in current policy) the alternative of land exchange entitlements on Letter B terms with a credit of $10 per square foot or cash compensation which will include an ex-gratia sum to bring the total compensation up to $17 per square foot if this cash offer is accepted prior to the date of reversion. The amount of cash compensation to be paid out will be reduced to the extent that land exchange entitlements are taken up.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lot listed at Annex B is required for a public purpose, namely site formation in Area 28(North), Tuen Mun New Town, New Territories.
