One (1) temporary structure on private land used for domestic purposes will have to be cleared. The structure is occupied by one family who if found eligible will be offered public housing in Tuen Mun. If the family is ineligible for public housing, then a space in a local temporary housing area will be provided. Ex-gratia domestic removal allowance of up to $1,000 may be payable to this family from the compensation vote of the Housing Department under which funds are available.

7

In addition to the temporary domestic structure mentioned above, a total of eight (8) other temporary structures including a pigsty, a kitchen, a latrine and agricultural stores will also have to be cleared.

8

The institution of formal resumption proceedings is recommended in order to avoid delays in obtaining the voluntary surrender of the private land which may be caused by succession difficulties, absentee landowners or prolonged negotiations with the landowners. As engineering works are scheduled to commence towards the end of May 1978 it is recommended that two months notice of resumption be given. The land to be resumed lies within the boundaries of the Tuen Mun Outline Development Plan, and landowners will be offered, subject to there being no change in policy, the alternative of land exchange entitle- ments on Letter 'B' terms or cash compensation. The amount of cash compensation to be paid out will be reduced to the extent that land exchange entitlements are taken up.

9

Hourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely site formation in Area 8, phase II, under package 18 of the Tuen Mun New Town engineering development, stage IIB.

(The District Officer Tuen Mun (Mr Peter NG Kwok-tai) will attend before the Council for the discussion of this item).
