The clearance will involve private land and Crown land.
Payment of compensation for beehives, crops, fruit trees, pine trees, fish ponds, graves, bone pots, wells, pipelines and fences will be necessary, together with ex-gratia allowance for cultivators and ex-gratia disturbance allowance for displaced pig breeders and poultry farmers, as well as "Tun Fu" ceremony fees.

Four village houses are situated within the resumption limits and will be resited under village removal terms. These houses have, therefore, been excluded from this resumption.

123 temporary domestic structures (103 on private land and 20 on Crown land) will have to be cleared. These temporary structures are occupied by some 121 families comprising about 540 people. The displaced families, if found eligible, will be offered public housing in Sha Tin or space in a temporary housing area in Sha Tin if found ineligible for public housing. Ex-gratia domestic removal allowance of up to $1,000 per family may be payable to these displaced families. Genuine cultivator-families who opt to continue cultivation elsewhere may be eligible instead for an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing.

In addition to the domestic temporary structures mentioned above, 350 other temporary structures will have to be cleared. Ex- gratia allowances estimated to total $1.29 million will be paid for 45 eligible commercial and industrial undertakings.

The institution of formal resumption proceedings is re- commended in the event that agreement with landowners for the voluntary surrender of their property cannot be reached and in order to avoid delays which may be caused, inter alia, by succession difficutlies or absentee landowners. As the land to be resumed lies within the boundaries of the Sha Tin Outline Development Plan, the landowners concerned will be offered, subject to the decision of this Council on memorandum XCC(78)52 which is to be considered on 27th June 1978, the alternative of land exchange entitlements on Letter 'B' terms or cash compensation. The amount of cash compensation to be paid out will be reduced to the extent that land exchange entitlements are taken up.
