found eligible will be offered public housing or spaces in a temporary housing area if found not eligible for public housing. Ex-gratia domestic removal allowance of up to $1,000 per family may be payable to these displaced families. As there is currently no public housing or spaces in a temporary housing area available in Yuen Long town although a temporary housing area is being built, eligible families may opt instead for an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing. Genuine cultivator-families who opt to continue cultivation elsewhere may also be eligible for this ex-gratia rehabilitation allowance.

In addition to the temporary structures mentioned above, 153 other temporary structures including 2 tanneries, 1 kindergarten, 5 shops and 6 workshops will have to be cleared. Ex-gratia allowances in accordance with current policy will be offered in respect of eligible commercial and industrial undertakings, as well as for the tanneries and kindergarten.

The institution of formal resumption proceedings is re- commended in the event that agreement with landowners for the voluntary surrender of their property cannot be reached and in order to avoid any delays which may be caused by absentee landowners or succession difficulties. As the land to be resumed lies within the boundaries of the Yuen Long Layout Plan, the owners of the agricul- tural land will be offered, subject to the decision of this Council regarding memorandum XCC(78)52 to be discussed on 27th June 1978, land exchange entitlements on Letter B terms with a credit of $13.50 per square foot in respect of up to half the land to be resumed and the payment of cash compensation which will include an ex-gratia amount to bring the total compensation up to $27 per square foot in respect of the balance of the land to be resumed. The amount of cash com- pensation to be paid out will be reduced to the extent that land exchange entitlements are taken up.

Since engineering works are scheduled to commence towards the end of September 1978, it is recommended that two months' notice of resumption should be given.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely to implement Yuen Long development Package 4 - phase I, engineering works in Yuen Long, New Territories.
