The institution of formal resumption proceedings is recommended in case agreement with the landowners for the voluntary surrender of their land cannot be reached and in order to avoid delays in obtaining surrender of the private land which may be caused by succession difficulties or absentee landowners. As the land to be resumed lies within the boundaries of the Sha Tin New Town, the owners concerned will be offered exchange entitlements and compensation in accordance with the policy approved by this Council on 27th June 1978. (Memorandum XCC(78)52 refers). The amount of cash compensation to be paid will be reduced to the extent that land exchange entitlements are taken up. The private land to be resumed is required by April 1979. It is, therefore, proposed to give three months' notice of resumption.
Advice Sought

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex C is required for public purposes namely, the development of Area 7B, in connection with the Sha Tin New Town Stage I, Phase 2 package 8 works.
