The clearance will involve both Crown land and private land and will require payment of compensation for fish ponds, crops, pine trees, fruit trees, bamboos, flowers, bee- hives and miscellaneous items (accommodation works) including wells, irrigation channels and fences. Ex-gratia allowance for cultivators will be paid together with ex-gratia disturbance allowance for displaced pig breeders and poultry farmers. Payment for the removal of graves, bone pots and 5 village shrines, as well as 'Tun Fu' ceremonial fees will also be necessary. Compensation for resumption and clearance for phase I is estimated at $98, 5 million and sufficient funds are available to meet this commitment from the loan from the Development Loan Fund (Yuen Long Industrial Estate) which has been made available to the Hong Kong Industrial Estates Cor- poration.

Some eighteen (18) temporary structures, including sixteen (16) on private land and two (2) on Crown land, used for domestic purposes will have to be cleared. These domestic structures are occupied by eighteen (18) families consisting of about ninety (90) persons, who if found eligible, will be offered public housing elsewhere, or space in a temporary housing area in Yuen Long if found ineligible. Ex-gratia domestic removal allowance of up to $1,000 per family may be payable to these displaced families and funds are available from the loan from the Development Loan Fund (Yuen Long Industrial Estate) which has been made available to the Hong Kong Industrial Estates Corporation. Genuine cultivator families who are eligible for public housing, but opt to continue cultivation elsewhere, will be eligible instead for an ex-gratia rehabilitation allowance of $5,000 per family, but will forfeit their priority for public housing.

In addition to the structures mentioned above, the resumption will involve clearance of seventy-six (76) other ancillary temporary structures including kitchens, bathrooms, watchman sheds and chicken sheds.

The institution of formal resumption proceedings is recommended in case agreement cannot be reached with the owners concerned for the voluntary surrender of their land and in order to avoid any delays which may be caused by succession difficulties and absentee landowners. As the engineering works should commence in (mid-December) 1978, one month's notice of re- sumption is recommended.
