On 15th February 1977, having considered memorandum XCC(77)8 (at Annex A), Honourable Members advised and the Governor directed that the Home Ownership Scheme should proceed on the basis of broad guidelines laid down by Members.

Since then, the Working Party on Home Ownership, with the cooperation of the Housing Authority and the departments concerned, has taken the scheme forward. Applications for the Home Ownership flats were invited in mid February and by 28th March over 24, 000 applications had been received by the Authority. It is intended that the flats should be balloted in May and the eligibility of successful applicants be investigated in detail in June.

When considering the conveyancing and other aspects of the Home Ownership Scheme, the need for new powers to be given to the Housing Authority was identified. The Housing Ordinance (Chapter 283), under which the Housing Authority was set up, is designed solely to deal with tenancies on public housing estates. Section 4 of the Ordinance empowers the Authority to construct new buildings so as to secure the provision of housing and amenities ancillary thereto. The term "housing" is defined to mean residential, industrial, commercial and business accommodation, buildings or premises. However the power is restricted by section 16(1)(a) of the Ordinance which empowers the Authority "to let to any person, for any period, any land in an estate, subject to the payment of such premium, rent or other consideration as the Authority may determine". The other provisons of the Ordinance provide for control over leased premises. It is therefore necessary to amend the Ordinance to give the Authority additional powers to sell and manage Home Ownership flats.

Working Group on Legislation

A Working Group was set up under the chairmanship of the Secretary for Housing to consider the statutory powers required by the Authority effectively to discharge its functions under the Home Ownership Scheme. The Housing (Amendment) (No 2) Bill 1978 (at Annex B) reflects the proposals of this Working Group, which has the support of the
