A BILL
To
Amend the Stamp Ordinance.
Enacted by the Governor of Hong Kong, with the
advice and consent of the Legislative Council thereof.
Short title.
Amendment of section 40. (Cap. 117.)
1. This Ordinance may be cited as the stamp
(Amendment) (No. 4) Ordinance 1978.
2. Section 40(4) of the principal Ordinance is
amended in paragraph (e) by inserting after "Ordinance"
the following

other than a conveyance on sale executed
for the purposes of section 17A thereof, ".
Explanatory Memorandum
Section 40(4)(e) of the principal Ordinance
exempts from stamp duty under the Ordinance all instruments
executed by the Housing Authority for the purposes of the
Housing Ordinance. Under section 17A of the Housing
Ordinance (which is at present contained in the Housing (Amendment) (No. 2) Bill 1978) the Authority is empowered
to sell land, and any conveyance on sale executed for
the purposes of that section will be excluded from the
general exemption from stamp duty by virtue of the
amendment in this Bill.
