It is not the policy of the Hong Kong Government to publish

these criteria. Each case is decided on its merits, and the

repatriation policy is not enforced where there are strong

humanitarian reasons against returning a particular individual

to China.

HOW MANY ILLEGAL IMMIGRANTS HAVE BEEN ARRESTED BUT SUBSEQUENTLY

ALLOWED TO STAY IN HONG KONG

4. Each case is considered on its merits and when there are

exceptional humanitarian factors involved an illegal immigrant

may be allowed to remain in the Colony. It is not the policy

of the Hong Kong Government to publish the figures for those

who are allowed to stay in such cases.

DO THOSE BEING REPATRIATED HAVE A RIGHT OF APPEAL OR TO LEGAL

REPRESENTATION

They have a right to appeal to the Governor. They are

also allowed access to legal counsel through any relatives or

friends they may have in Hong Kong.
