WIDOWER'S PENSION

24.

A widower who is under 65 years of age and:-

(i) is and has been permanently incapable of self-support for

not less than ten years; and

(ii)

has been wholly or mainly maintained by her during this time;

is entitled to a widower's pension at the standard weekly rate of £14.50 if his wife satisfied the relevant contribution condition.

The contribution conditions are the same as for widow's benefit paragraph 22:

The pension is not payable if the widower re-marries or cohabits with another woman as her husband.

25. HOW AND WHEN TO CLAIM A WIDOWER'S PENSION

A claim form is obtainable from the Department of Labour & Social Security and should be completed and returned within 6 months after the wife's death, otherwise there will be a loss of benefit.

GUARDIAN'S ALLOWANCE

26. FOR ORPHAN CHILLREN

A guardian's allowance is a payment of £3.60 a week to the person who takes into his family an orphan child both of whose parents, or step-parents are dead. Special rules apply to the children of divorced parents, adopted children, illegitimate children, and children whose parents cannot be traced.

There is no limit to the number of orphans in respect of which the allowance is payable at any one time.

27. WHAT ARE THE CONTRIBUTION CONDITIONS?

The contributions of either one or the other of the parents (including step- parents) count for guardian's allowance.

There are two contribution conditions:-

SECOND:

Either one or the other of the parents must have paid at

least 26 contributions between 3 October 1955 and the date of the death of the last surviving parent.

(i)

that person must have paid or been credited with at least 13 contributions during the complete contribution year immediately preceding the year in which the last surviving parent dies. (A new contribution year begins on the first Monday of each calendar year); or

(ii) that person must have paid or been credited with an average of at least 13 contributions a year since 3
