Rule IV Holidays with Pay

Section 4 Compensation for holiday work

Any employee who is permitted or suffered to work on any regular holiday, not exceeding eight (8) hours, shall be paid at least two hundred per cent (200%) of his regular daily wage. If the holiday work falls on a scheduled rest day of the employee, he shall be entitled to an additional premium pay of at least 30% of his regular holiday rate of 200% based on his regular wage rate.

Section 5 Overtime pay for holiday work

For work performed in excess of eight hours on a regular holiday, an employee shall be paid an additional compensation for the overtime work equivalent to his rate for the first eight hours on such holiday work plus at least 30% thereof.

Where the regular holiday work exceeding eight hours falls on the scheduled rest day of the employee, he shall be paid an additional compensation for the overtime work equivalent to his regular holiday-rest day for the first 8 hours plus 30% thereof. The regular holiday-re st date rate of an employee shall consist of 200% of his regular daily wage rate plus 30% thereof.

Note: Regular holidays are statutory holidays

Special holidays are holidays decreed by the President.

Section 38

(3) If an employee works for and at the request of his employer more than eight hours in one day or, in the case specified in para- graph (ii) of the proviso to subsection (1) of this section, more than nine hours in one day, or more than forty-four hours in one week, he shall be paid for such extra work at the rate of not less than one and a half times his hourly rate of pay irrespective of the bais on which his rate of pay is fixed.

Section 37.

Any employee who at his own request works for an employer on a rest day shall be paid for that day at not less than the ordinary rate of pay for one day' work.

(3) Any employee who at the request of his employer works on a rest day shall be paid an extra day's salary at the ordinary rate of pay for one day's work in addition to the ordinary rate of pay for that day.
