(3) The right to annual leave as meant in (1) and (2) above shall lapse within six months following entitlement thereto, an employee does not make use of this right, other than for reasons given by the employer or for special reasons to be laid down by the Head of the Labour Inspection Service.

Should the employer consider it necessary in the valid interests of the undertaking, annual leave may be postponed for up to six months reckoned from the day upon which the worker became entitled to such leave.

By mutual agreement between the employer and the worker,

annual leave may be divided into several parts.

Article 48 (Annual Leave with Pay)

1.

An employer shall allow workers eight days leave with pay for one full year service without absence, and three (3) days leave with pay for not less than ninety (90) per cent attendance of one year's service.

An employer shall grant one day's paid annual leave for each consecutive year of service exceeding one year, in addition to the leave mentioned in the preceding paragraph, for the worker who has continuously worked for at least two years of service. However, the employer may pay normal wages for the number of days in excess of twenty days instead of allowing the paid leave, if the total number of leave days exceeds twenty days.
