It is worth pointing out that in 1976 out of a total of 11,801 establishments inspected, 7,726 or about two-thirds were found violating certain laws the most common violations being inadequate or non- keeping of records, non-payment of overtime pay, non- payment of cost of living allowance, non-payment of the minimum wage and non-payment of the 13th month pay. The Department of Labour is mindful of the employment situation in the country and believes in the long-term benefit of education and persuasion of employers. As a result no prosecution has been instituted in recent years, but restitution measures have been taken by employers.
8.13 With the recent strengthening of the
Department of Labour and the continuing restructuring of trade unions in the country (at present about 8% of the labour force is unionised), the Philippine Government hopes to make law enforcement more effective in the years ahead.

The Employment Act allows considerable scope for exceptions to be made even to the most restrictive labour standards such as hours of work, rest, and minimum age for employment. The Singapore Government generally adopts an understanding attitude towards employers' applications for approval to operate under exemption. In 1976 the Ministry of Labour aproved 85 applications for overtime exemption and 32 applications for night-work exemption for female workers.
