Malaysia (7 days for less than five years service and 14 days for over five years service) and Singapore (7 days for less than ten years service and 14 days for over ten years service). Korea has the most generous paid annual leave provisions : for full attendance the annual leave earned may be as high as 20 days, plus one day's leave for each consecutive year of service exceeding one year.

405

The right of a worker to paid annual leave is always conditional upon a minimum period of service. One year of continuous service is a very common basis. In some countries (Korea, Malaysia and Singapore) a minimum attendance rate (80%, 90% or full attendance) is further imposed.

406

In the case of Hong Kong, Korea and Singapore the annual leave must be taken within 12 months. In

Indonesia the leave must be taken within six months. This is a matter for mutual agreement in Thailand, while Malaysian and Philippine legislation is silent in this respect.

4.7

Hong Kong does not permit payment in lieu of leave. Most countries encourage their workers to take the leave due to them. But in Indonesia, Korea and the Philippines, payment in lieu of leave is permitted by law. In Malaysia, Singapore and Thailand, payment in lieu of leave is also an accepted practice.

4.8

Except for Hong Kong and Indonesia where at least 7 days and 6 days of annual leave respectively must be taken consecutively, no other countries insist on this aspect.

4.9
