Thank you for your minute of 30 December.

I must say I am surprised that the Legal Adviser has said that this is for ODM to pursue since Mr Handy was offered an appointment under a letter issued by the FCO and the decision on Mr Handy's withdrawal from the terms of that offer was made entirely by the FCO.

3. It seems to me that prior to consideration of legal action it will be necessary to establish the reasons for the withdrawal and the justification for it in a more precise manner than given by the notes which you have copied to me. For example, it is by no means clear from the notes whether you regard the cancellation of the assignment as being at Professor Turner's instigation, Mr Handy's or your own, and these cases whether it was with your full approval. If we are to handle this, perhaps you could let me have a more precise explanation of the events and the FCO view of them which can be submitted to Mr Bickford and, if agreed, to the Treasury Solicitor.

4. Every attempt has been made to establish the whereabouts of Mr Handy. Department of Applied Economics, Cambridge, say that he has left them and they do not know where he is. There is no reply to telephone calls to his old home number. His name does not appear in the Cambridge & District telephone directory and Directory Enquiries cannot help. We are left, therefore, with the bank address. Do I assume from your minute that your Legal Adviser's view is that we cannot proceed on this without a furtiter address?

5. If we are to handle this we will need the original of the undertaking to repay which I sent you under my minute of 15 December.
