As necessary, special provisions concerning paid educational leave shall be established

A

(a) where particular categories of workers,

such as workers in small undertakings, rural or other workers residing in isolated areas, shift workers or workers with family responsibilities, find it difficult to fit into general arrangements; (b) where particular categories of undertakings, such as small or seasonal undertakings, find it difficult to fit into general arrangements, it being understood that workers in these undertakings would not be excluded from the benefit of paid educa- tional leave.

There might be practical difficulty in making such special provisions.

Conditions of eligibility for paid educational leave may vary according to whether such leave is intended for

(a) training at any level;

(b) general, social or civil education; or (c) trade union education.

There should not be any difficulty in applying this Article.

The manner in which paid educational leave is to be granted should be determined by employers and the workers concerned as is the case of paid annual leave. The employer should have some flexibility in determining the number of workers to be released at any one time for paid educational leave so as to reduce dis- ruption of production to a minimum.

There should be specific provisions on

(i) How often can a worker be granted paid

educational leave? Once in every three,

five or ten years?

(ii) How long should paid educational leave be?

Consideration should be given to the possible exclusion of small-sized undertakings, say those employing below 20 or 10 workers, from the coverage of paid educational leave provisions.
