All premises used by workers shall have sufficient and suitable ventilation, natural or artificial or both, supplying fresh or purified air.

Under section 93 of the Public Health and Urban Services Ordinance, the owner or licensee of any scheduled premises may be required by a notice served upon him, to install a ventilating system in such premises which will provide for each person who may be accommodated therein an amount of outside air not less than that specified in the Second Schedule.

The Ventilation of Scheduled Premises (New Terri- tories) Regulations and the Ventilation of Scheduled P Premises By-laws (both are made under the Public Health and Urban Services Ordinance, Cap. 132) provide for control over ventilating systems in scheduled premises in the New Territories and the urban areas respectively. Ventilation systems in commerce and offices are governed by the Building (Ventilating Systems) Regulations made under the Building Ordinance, Cap. 123. Regulation 5(1)(a) of these Regulations requires that the owner of a ventilating system to which these regulations apply shall keep such ventila- ting system in safe and efficient working order at all times.

Control of natural ventilation and lighting in shops and offices is provided for in the ventilation By-laws (which apply to urban areas only) made under the Public Health and Urban Services Ordinance, Cap. 132.

By-law 4 of the Ventilation By-laws provides that "save with the permission in writing of the Urban Council, no person shall erect or place or maintain, or cause to be erected or placed or maintained, in any open space any obstacle to the access of ventilation or light to any building, or any part of any building".

By-law 5 states that "no person shall, by erecting or maintaining any structure or fitting whatsoever or by the placing of any household goods or merchandise, obstruct any window of any building or any part of any building".
