1. AS YOU ASSUMED, THE REFERENCE TO QUOTE OBJECTIONS UNDER ICAO UNQUOTE WAS MADE IN THE SENSE THAT DANEGELD OR ANY OTHER DISCRIMINATORY PAYMENTS BY AN AIRLINE TO A FOREIGN GOVERNMENT (IN THIS CASE TMA TO THE HONG KONG GOVERNMENT) MIGHT BE ARGUED AS BEING IN BREACH OF ICAO CHARGING PRINCIPLES
RELATING TO AIRPORTS.
2. AS FOR OWNERSHIP OF THE ROUTE BETWEEN HONG KONG AND BEIRUT,
THIS ROUTE DEPENDS ON THE PROVISION OF SATISFACTORY AIRPORT FACILITIES, WITHOUT WHICH THE ROUTE WOULD HAVE NO VALUE. WE
ARE OPPOSED IN PRINCIPLE TO SUCH DANEGELD PAYMENTS AND HAVE AGREED TO THIS IN THE PAST ONLY IN EXCEPTIONAL CASES SUCH AS VIENTIANE WHERE CPA WERE IN EFFECT DENIED THE RIGHT TO OPERATE A PROFITABLE SERVICE IN COMPETITION WITH RAL. AS THE SOLE PROVIDER OF THE FACILITIES AT HONG KONG, WE CONSIDER THAT IF ROYALTY IS INSISTED UPON FOR USING THE ROUTE, WE SHOULD BE THE RECIPIENT.
3. IN THIS CONTEXT, WE SHOULD BE GRATEFUL IF YOU WOULD PROVIDE
DETAILS OF THE POSSIBLE LOSSES B.A STAND TO SUFFER FROM THE INTRODUCTION OF TMA'S SERVICES.
4. WE PROPOSE TO DISCUSS ALL OF THIS WITH ROGERS AT THE MEETINGS ARRANGED FOR 6 AND 7 MARCH AND SHOULD BE GRATEFUL IF YOU WOULD WITHHOLD MAKING AN OFFER TO THE LEBANESE UNTIL THIS DISCUSSION HAS TAKEN PLACE.
