Annexed for the consideration of Honourable Members are the Railways (Amendment) Bill 1978 (Annex A) and the Kowloon-Canton. Railway (Amendment) Regulations 1978 (Annex B).

The Railways Ordinance (Chapter 99), as it at present stands, can cover the construction and operation of any railway in Hong Kong. In practice, however, it governs only the Kowloon-Canton Railway (British Section) which is currently the only operating railway in Hong Kong. The Mass Transit Railway is governed by a separate Ordinance, the Mass Transit Railway Corporation Ordinance (Chapter 270). In order to avoid any confusion, it is now proposed to amend the Railways Ordinance to reflect this new situation, that is to change the title of the Railways Ordinance to the Kowloon-Canton Railway Ordinance. The opportunity is also taken to bring certain provisions of the Ordinance up to date, to repeal other provisions no longer required, and to provide for the creation of a new post of deputy general manager. Some of the regulatory provisions in the Ordinance are transferred to the regulations at Annex B. The major part of the bill contains consequential amendments.

The title of the Ordinance is to be changed to Kowloon- Canton Railway Ordinance and all references to "a railway" are to be replaced by "the railway", which term is defined to mean the Kowloon-Canton Railway.
All references to "Administrator" and "Chief Resident Engineer" are to be substituted by "General Manager". In practice, all three titles have referred, for a long time, to the same person.
Clause 3(a) of the bill seeks to amend section 2 to provide for a new post of Deputy General Manager.
