CLP personnel safety to be involved in the inspection of a complex MTRC system while commissioning and other installa- tion work is still in progress, and the third that after the commissioning of the MTRC's electrical installations the MTRC will inevitably wish to modify its installations in many ways and this would involve yet further inspections.

Consequently the CLP and the MTRC have jointly proposed that the CLP should be relieved of its inspection responsibilities under the Electricity Supply Regulations in favour of inspection by the MTRC itself.

The MTRC has proved to the satisfaction of the Director of Public Works that it possesses both the capability and the capacity to carry out the necessary inspection of the electrical installations referred to in paragraph 3 above, within a time scale to accord with the planned implementation of the railway works,

Regulation 42 of the Electricity Supply Regulations

provides that:

"The Governor in Council may at any time,

upon it appearing to him that adequate provision has been made for the examination, inspection and testing of the wires, fittings, installations, apparatus and equipment in or upon any works, building or other premises, by order specifying such works, building or premises exempt the same from exami- nation, inspection and testing under these regulations.

and the MTRC has applied for an order exempting all its electrical installations for the railway from inspection by the power companies prior to commissioning of the various portions of the railway. It should be noted that such exemption, if granted, would apply only to the actual railway premises as defined in section 2 of the Mass Transit Railway Corporation Ordinance (Chapter 270) and not to any associated development.

The Hong Kong Electric Company Limited will shortly face the same difficulty of inspection in respect of electrical installations for those sections of the railway to which it will supply electricity. If an exemption order were granted, this would absolve both the China Light and Power Company Limited and the Hong Kong Electric Company Limited from their obligations to inspect electrical installations within the railway premises.
