(c) The road and jetty over which the right-of-way shown coloured brown on the plan annexed hereto is given shall be constructed, maintained and repaired by the Government. The purchaser on demand shall pay a proportion of the cost of the said construction repair and maintenance and such proportion shall be decided by the Director of Public Works at his absolute discretion and whose decision in this respect shall be binding on the purchaser.
(a) The grant of the rights-of-way specified in Special Condit ion 33(a) hereof shall be in such form and on such conditions as may be approved by the Registrar General (Land Officer) and shall not give the purchaser the exclusive right to their use. The Government reserves the right to grant rights-of-way over such roads and jetty to the owners of any other lots in the vicinity, now or in the future, or to take over the whole or any portion thereof for the purposes of a public street without payment of any compensation to the purchaser or to the other owners to whom rights-of-pay over the whole or any portion of the roads and jetty may have been granted.
(34) Wherever in these Conditions it is provided that the Government or the Director of Public Works shall or may carry out works of any description on the lot or any part thereof or outside the lot (whether on behalf of the purchaser or on the failure of the purchaser to carry out such works or otherwise) at the cost of the purchaser or that the purchaser shall pay or repay to the Government or to the said Director on demand the cost of such works, such cost shall include such supervisory and overhead charges as may be fixed by the said Director.
(35) (a) The boundaries of the lot shall be determined by the Director of Public Works (whose decision shall be final) before the issue of the Crown Lease. In the event of any excess or deficiency in area being found to exist as compared with the area specified in the Particulars of the Lot the amount to be paid by or to be refunded to the purchaser in respect of such excess or deficiency will be calculated at the rate per square metre at which the lot is sold.

Cost of safety and supervisory services
The purchaser shall, at his own expense, arrange for the installation of such telephone link between the lot and the Commissioner of Mines Office at the Cat on Road Government offices, Kowloon, and between the lot and the Secretary of Statefor Defence Establishment on stonecutters Island as the said Commissioner shall deem necessary.
(37) The purchaser shall pay on demand any sum which the Secretary of State for Defence shall certify (at his absolute discretion) to be the cost for the provision of administrative, fire, safety and security services for the lot. The purchaser shall give the Secretary of State for Defence or his officers or any Servants or Agent of the Crown a free and uninterrupted right of access over the lot for the purpose of provision of these services.
