(c) The quantity of explosives permitted in any building te be erected on the lot shall be determined by the distance of the said building, from other buildings or installations in accordance with the Ammunition and Explosives Regulations (Land Service).

(a) No building or buildings shall be erected on the lot except a factory and a warehouse or warehouses for the purposes stated in Special Condition No. (9)(a) above, ancillary offices and such canteen and other welfare facilities (but excluding residential quarters) for workmen employed on the lot as may, in the opinion of the Director of Public Works, be necessary and also such quarters as may be required for watchmen or caretakers or both who, in the opinion of the Commissioner of Mines and the Secretary of State for Defence, are essential to the safety and security of the buildings. The number of watchmen and caretakers to be accommodated in any quarters and the number and size of any such quarters shall be subject to the approval of the said Commissioner, and the floor area of any such quarters shell in any event not exceed 5 square metres for each person to be accommodated. Any such quarters shall not be used for any purpose other than the residential accommodation of such watchmen or care- takers or both.

(e)

The purchaser shall not install any furnace, boiler or other plant or equipment or use any fuel that might in any circumstances produce smoke without the prior written consent of the Commissioner for Labour. The grant of such consent shall not be deemed to modify or alter in any way the Government's powers for controlling smoke now or hereafter imposed by any Ordinance, byelaw, regulation or other enactment.

(f) The method of storage of goods and the nature and the volume or quantity of the goods stored on the lot shall be subject to the approval of the Director of Fire Services and the Commissioner of Mines.

Commence to (10)(a) The purchaser shall, within 18 months from the date on which operate possession of the lot is given, commence to manufacture watergel

explosives in accordance with these Conditions and in a manner satis- factory to the Commissioner of Mines and shall continue to operate the said factory and any warehouses in accordance with all Ordinances and Regulations relating to the said manufacture and storage of watergel explosives which are or may at any time be in force in Hong Kong or laid down by the Director of Lend Services Ammunition.

(b) Without prejudice to the provisions of (a) hereof, in the event of the purchaser not commencing to manufacture watergel explo- sives in accord nce with the provisions of (a) hereof within the period specified, the purchaser shall pay to the Government on demand the sum of $10,000.00, as liquidated damages for each month or part there f during which the purchaser has not commenced to manufacture watergel explosives in accordance with provisions of (a) hereof.

The purchaser shall within 60 days form a date to be speci- fied in a letter from the Director of Public Works

(a) submit to the Commissioner of Mines an application in

accordance with regulation 29 of the Dangerous Goods (General) Regulations for a licence to manufacture cartridged watergel explosives; and

(b)

submit to the Director of Fire Services an application for storage licences to covor bulk storage of any ingredients or other substances required for the manufacture of cartridged watergel explosives, which under the Laws of Hong Kong are classed as dangerous goods.
