DRAFT ORDER-IN-COUNCIL
WHEREAS by grant, usage, sufferance and other
lawful means Her Majesty The Queen has jurisdiction
within the New Territories of Hong Kong: AND WHEREAS
provision was made for the exercise of such jurisdiction
by Order-in-Council made on the 28th day of October 1898.
AND WHEREAS it is now expedient to make further
provision for the exercise of such jurisdiction and for
the government of the New Territories as part of Hong
Kong:
Now, therefore the preamble up to this point
might be omitted/ Her Majesty, by virtue and in exercise
of the powers vested in her by the Foreign Jurisdiction
Acts, 1890 and 1913, or otherwise, is pleased, by and
with the advice of Her Privy Council, to order, and it
is hereby ordered as follows
1.
The Governor of Hong Kong, with the
advice and consent of the Legislative
Council thereof, shall continue to be
competent to make laws for the peace,
order and good government of the New
Territories of Hong Kong.
2. No such law shall be invalid by reason
that it purports, expressly or by
implication, or has effect, to extend
beyond 1 July 1997.
3. The provisions of Article I shall
authorise the Governor of Hong Kong,
