Therefore, if Yang, J. is to take on the Chairmanship, it would seem to
me that the only safe course would be for him to resign from the Bench unconditionally, a course he may very well be unwilling to take.
I fear that my opinion on these matters will be unwelcome to
you, but I thought I ought to sound this note of caution. I must make
it clear that I have not sought the views of the Lord Chancellor and the opinions I have expressed are only my own. If you find it necessary to raise these issues at ministerial level, I am sure the Lord Chancellor will
be very willing to give your Secretary of State such help and advice as
he can.
