1. Please refer to your letter HKG 400/1 of 26 April on the above subject.
2. In the case of the BVI, the existing dormant commission (designating the Chief Secretary - now Deputy Governor as next in line of succession) was promulgated under the provisions of Section 4(1)(a) of the Virgin Islands (Constitution) Order, 1967. That Order however has now been repealed and replaced by the Virgin Islands (Constitution) Order, 1976, Section 5(1)(a) of which states that the Deputy Governor will be next in line of succession to the office of Governor. The existing dormant commission is therefore no longer either in force or is necessary; it did, however, go on to designate the Attorney-General as next in succession after the Chief Secretary and, to that extent, you may consider that a new dormant commission may be necessary.
3. In any event, I entirely agree that the classification of a dormant commission ought not to be in the 'personal' series. It need be graded no higher than Confidential.
