MOTION ON CAPITAL PUNISHMENT IN THE DEPENDENT OVERSEAS TERRITORIES

1. Mr Stewart asked me to examine the ways in which the Motion on capital punishment could be set down.

2. Mr Hunt, Assistant Parliamentary Clerk (Ext 5052) in the absence of Mr Worsnop, Parliamentary Clerk, referred to the PUS's reservations (minute of 13 December) of raising this as a private members Motion. The Secretary of State, who had seen the PUS's minute,. mentioned (minute of 16 December 1977) that capital punishment issues have been traditionally raised by back benchers.

3. Mr Hunt suggested that I should contact Mr David Roberts in the Cabinet Office (233-7645) who deals with future legidation.

After I had explained the Motion Mr Roberts considered that the only course is for the Private Secretary to discuss the possibilities of introducing the Motion with the Lord President's Private Secretary since Mr Roberts believes that as matters stand it would not be possible to introduce the Motion in Government business during this Session.
