We will of course be quite content to take on the burden of preparing a paper on the legal and constitutional implications of the various alternatives to the existing procedure. As you say, most of the material already exists in the FCO, and I do not anticipate much difficulty in pulling it together.

I have asked Tony Rushford to prepare the first draft of such a paper which I will look at. We will then, as you suggest, seek to clear it with the Law Officers' Department, the Lord Chancellor's Office and the Home Office.

I am sending a copy of this letter to Mike de Winton (Law Officers' Department) and also to John Stewart and Tony Rushford.
