acceptable. I would however like to see a note of added caution introduced in the section on the possible use of CR55. This should remain very much an exceptional measure and our willingness to proceed under it in any particular case may well depend (as it did in the Yau Ma tei case) on wider considerations. I therefore suggest that in section (ii)(c) of your note you should add a statement to the effect that action under CR55 will only be taken in very exceptional cricumstances and that it should not be assumed that a case will necessarily be proceeded with in this way just because the conditions set out in the preceding subparagraph have been met.
