1. I consider that there is not enough evidence given in the attached file to justify the use of CR55 in the case of the above named.

My reasons for this conclusion are:-

The physical identification of Mr TSUI Sheung-lun was made on the evidence of one man and only by photograph. This witness was himself a convicted criminal who said in Court that he would give evidence against Police Officers;
It seems that the identification parade did not involve the exclusive identification of TSUI. MA Ting-kit might have been asked to pick out all the men that had asked him for money and he was doing this from some 2,400 photographs. Therefore, the fact that TSUI was identified and that his name appeared in the Account Book is not necessarily in itself conclusive;
The accused is identified in the Account Book simply
Is this a name in Hong Kong like Smith or Jones here and therefore not a reliable means of identifying a man whose name is TSUI Sheung-lun?
3. I think on balance it is quite possible that:-
a)
and
MA might have had a grudge against TSUI and picked out his photograph to get even with him even though he had not paid him any "tea money";
b) MA was possibly so anti-policmen that he was indiscriminate
as to who he picked out in the identification parade as long as he made things difficult for some of them.
