Where a Governor who is, or subject to attaining the age of 50 will be, eligible for a pension under the Governors' Pensions Scheme becomes employed in the Home Civil Service or the Diplomatic Service within 12 months or such longer period as the Civil Service Department may in any particular case allow after ceasing to serve as a Governor, he may elect that instead of his being granted a pension under the Governors' Pension Scheme the provisions of this Scheme shall apply to him as if his service as a Governor has been passed in the Home Civil Service or in the Diplomatic Service, as the case may be.

Where the Governor, having had previous service in the Home Civil Service or the Diplomatic service, returns to such service and elects to have Rule 12.4 of this scheme applied to him, the salary to be taken for superannuation purposes in respect of his service as a Governor shall be whichever is the more favourable of the pensionable emoluments actually enjoyed during his service as a Governor or the salary he would have enjoyed from time to time during his service as a Governor if he had remained in the Home Civil Service post or Diplomatic Service post from which he was appointed to a Governorship and had been granted any increments and all increases appropriate to his grade.

Where a Governor who is not eligible for a pension under the Governors' Pension Scheme becomes employed in the Home Civil Service or in the Diplomatic Service within 12 months or such longer period as the Civil Service Department may in any particular case allow after ceasing to serve as a Governor, his employment as a Governor may, for the purposes of this scheme, be treated as if it had been passed in the Home Civil Service or the Diplomatic Service, as the case may be.

Where a Governor has elected for a pension to be paid under Rule 3.12] of the Governors' Pension Scheme 1978, no credit will be given to him in this Scheme for any period of civil service where it has already been counted in the calculation of his pension entitlement under the Governors' Pension Scheme, and no deferred pension or other benefit will be paid to him under this Scheme in respect of such service.
12.8
Where a Governor eligible for a pension under the Governors' Pension Scheme becomes employed in service in respect of which a pension and lump sum under this Scheme cannot, apart from this paragraph, be granted to him but which is of a kind in respect of which such benefits are granted to persons retiring after the requisite number of years then, notwithstanding that he has not completed the requisite number of years' service, a pension and lump sum may on his retirement be granted to him under this Scheme.
