An Ordinance to amend the Police Force Ordinance.

[7th November, 1977]

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Police Force (Amendment) Short title. (No. 2) Ordinance 1977.

2. The principal Ordinance is amended by adding after section 30 Addition of the following new section-

"Summary dismissal.

(Cap. 89.)

31. (1) Notwithstanding any provision of this Ordin- ance and any other law, provision of Colonial Regulations or the Regulations of the Government to the contrary, and without prejudice to section 38, the Commissioner may summarily dismiss any police officer whom he is satisfied is guilty of disobedience of police regulations, or any police orders whether given verbally or in writing.

(2) The Governor may, if he thinks fit in any partic- ular case, declare that a police officer dismissed under subsection (1) shall for the purposes only of the Pensions Ordinance be deemed to have retired from the public service in accordance with paragraph (d) of section 6 of the Pensions Ordinance.".
