just remembered it. I would submit that if he is the sort of man who can forget $100,000 which was paid about a year ago he must be a very rich man indeed. hen further questioned on the point he said his memory was poor or getting old and when asked how old he was he said he was 43. One almost felt he was joking with this Court to say that at 43 one's memory starts to get poor. He has been serving in Folice Force when retiring age is 55 whereas anybody who knows anything about anything man is at the height of his powers it is quite abcurd and then to claim poor memory at all when he seemed to suffer no vestige of poor memory on conversations he alleged took place between himself 1st and 2nd defendants

years ago and even down to the very shirt 1D was wearing JAC shirt. Ask Your Honour to consider supposing one bought a car a year ago for $15,000 to ask is it likely for some extraordinary lapse of memory he paid 5,000 a year later. Purchasing car is a mundane sort of event for a lot of people whereas presumably one of the very few times in his life he had to find legal costs an event in his life so far one of the greatest events ever happened to him and yet he can calmly forget a $100,000. Another indication to show he is a man of wealth, he has a flat he used to rent it out, he doesn't now as he does not need to. Loss of rent of $3,000 he doesn't choose to stay

- flat but liked to stay in a very expensive hotel.

He was preparing to leave Hong Kong shortly. when Mr. Hampton asked him about that everyone in Court had impression he was going to emigrate or leave for a considerable period of time which would be understandable in the circumstances. when I asked him he was going yet on another overseas holiday. These sort of expenses are for a man who says he only has 20,000.

He must have been the Crown's most important witness. Lie was asked by Hampton as to whether he mentioned D1, D2 and fir. X in the original 3 tape recordings and he agreed he mentioned D1 and r. X but not the 2nd Defendant. questions asked by ir. Hampton as to when he first mentioned 2D and he said september this year. The next question asked did you mention any other Europeans still serving and he said "Yes". Apart from 1D and 2D later he said there was only 1 other senior officer who was not Chinese who he ever bribed at all. However later next day when I started/cross-examine him he started to change he said he told ICAC about 2D about 8 months ago. Even then that was after his conviction, after he had made the 3 tapes.
