The issues as I see it in this case are comparatively simple. As to the first charge Your Honour has heard a number of witnesses who are actively engaged in the Bay View Division within the charge period in collecting money from gambling and drug establishments and a number of those witnesses gave evidence that in addition to their roles as collectors they also transmitted information to these establishments when police action against them was imminent. These witnesses are of course accomplices and added to charge as co-conspirators and Your Honour will warn himself of danger of accepting their evidence unless corroborated but that does not preclude you from accepting such evidence without corroboration you have warned yourself. There is corroboration of evidence given by collectors Chan Cheong wing, Lau wai, Chiu Chi Kung and Chau Chi Yung, corroboration of their evidence was to handling very considerable sums of money in the form of cash by virtue of the bank accounts that have been produced in evidence. False name bank accounts of Cheung Cheuk Fun Exh. at P32b, P39B, P43b, F51b, F59b and P65b. ong Tak Wing and wong Chi Wing maintained current accounts at the wing Lung Bank North Point and records of their current accounts PO2A and F87A. In my submission a perusal of history of these bank accounts corroborates evidence of collector witnesses in relation to statements made by them of a large sum of money which passed through their hands within relatively short period of time. None of these witnesses was in fact challenged on this evidence as to the collections nor on the evidence as to the tipping off of the illegal establishments. Your Honour will recall that those witnesses starting with Chan Cheong ing in 1971 receiving through to wong Chi wing in 1973 and early 1974 all mentioned particular establishments, gave names, trade name or proprietors and in some cases identified them by address. Throughout case striking corroboration of particular establishments and of amounts paid by those establishments.
