Although I would rule that those documents are admiscible under
section 22 of the Evidence Ordinance, I would like to make reference to the submission made by Mr. Hampton regarding the judgment of the full Court in H. v. sturgeon on the drafts in that case being records of the Northern Bank. I am bound to follow the reasoning in that judgment but I would add that in respect of the drafts, that is the originals, they form part of the Hang Seng Lank as there is evidence from one of the
bank,r. Cha Chuen Hoi, that such drafts are returned by the corres- pondent bank to the flang seng Bank after they are negotiated and the Hang Seng Bank's accounts with the correspondent bank are debited with the payments, such drafts are returned to the Hang Seng Bank as
debit advice notes. I would say that these form part of the records
officers of the
of the Hang Seng dank and are also adrissible under section 20 of the Evidence Ordinance and so also the application forms and copies of drafts of the wing Lung Bank admissible under section 20 as being
records of the bank.
