Earlier this morning I informed Court that at that stage

I had no intention of bringing in other names and that before doing so I would inform Court to give my learned friend an opportunity of being heard. I have reached that stage. I would however be grateful if argument

took place in absence of witness. Purpose connected

with my cross-examination.

Mr. Hampton: Purpose is related to credibility of the witness in

relation to 2 aspects: murder investigation which has

ventilated and alleged corrupt collections in

Wanchal division and I further mention which I do not wish to disclose at this stage. Perfectly prepared to inform my learned friend in advance of 2 nanes I wish

to mention. It may well be that no investigation is

envisaged.

Kr. Sceats:

I fail to see relevance of grounds advanced by Mr. Haupton. Refors to murder investigation and credibility ventilatod. This man is serving term of imprisonment. Convicted by jury. Appeal was hoard and commutation of

sentence was heard by Ex. Co. and investigation conducted

regarding witness. Investigating officer has not been called as a witness to say what result of inquiry is. Any inquiry into witness did not lead to his suspension.

I do not see any relevance in this line. As to relevance

of corrupt collections in Wanchai area this do not come

within period in charge it was period after he left

Bay View Station. It is not part of Crown case that

Wanchai activities relate to Bay View Division. I

have listened to these tapes nothing said by witness

that contradicts he said here. As to disclosure of

names in tapes in course of rendering assistance to

ICAC an allegation of corruption whether substantiated

or not is extremely damaging to person when it is made.
