REPORT OF THE COMMISSION OF INQUIRY INTO

THE LEUNG WING-SANG CASE

On 6th February, 1976, I was appointed Commissioner, under section 2 of the Commissions of Inquiry Ordinance (Chapter 86), with

the following terms of reference :

"To inquire into :

(i) the circumstances leading up to and surrounding

the arrest and charging of LEUNG Wing-sang; and

(ii) whether or not these circumstances might have

prejudiced LEUNG's trial."

Mr. H.J. Somerville, Senior Crown Counsel, was appointed

Counsel for the Commission. Mrs. Alice Wong (£), Assistant

Secretary of the Judiciary, was appointed Secretary to the Commission.

A copy of the Instrument of Appointment is attached as

Appendix I.

1. Procedure

Mr. Somerville, Mrs. Wong and I met privately on two occasions

to discuss procedural matters soon after the Commission had

been appointed.

Appeals to the public requesting information were made

through the news media.

Three interested parties were legally represented :

(1) Mr. Neil Macdougall, Deputy Director of Public

Prosecutions, for the Royal Hong Kong Police Force,

(2) Mr. Herman H.il. Poon(), barrister, for

LEUNG Wing-sang, who was given legal aid by

Government,

(3) Mr. Ronny F.H. Wong(), barrister,

for LAU Cheong-wah.
